Why stores are getting letters

Website lawsuits keep coming, and Shopify stores are now the most common target. These four numbers come from EcomBack and WebAIM.

3,948

ADA website lawsuits filed in 2025

EcomBack 2025 annual report

46.6%

of ADA website suits in the first half of 2026 named a Shopify store

EcomBack 2026 mid-year report

24.9%

of 2025 suits targeted sites that already had an accessibility widget

A widget sits on top of your store. Inclusely fixes the store itself.

Do accessibility overlays make a site compliant? No. An overlay adds a toolbar on top of your pages, but the missing labels, faint text and broken focus are still in the code. Screen reader users often turn overlays off, and courts look at the site itself.

Accessibility widget

  • Adds a floating button and toolbar to every page
  • Tries to patch the page in the shopper's browser
  • Many screen reader users switch it off
  • About a quarter of 2025 lawsuits named sites that had one

Inclusely

  • Nothing added to your storefront by default
  • Fixes your product data, settings and theme code
  • Works with the screen reader a shopper already uses
  • Keeps a dated record of every change

Each law points to WCAG. Inclusely tests to WCAG 2.2 AA and lets you filter results to the version your law uses.

What we will never tell you

That your store is fully compliant, that you cannot be sued, or that a badge on your site proves anything. Software finds a lot, but not everything a person with a disability runs into.

So every report says which checks were automatic, which ones a person did, and which are still open.

Questions store owners ask

Is Shopify ADA compliant?

Shopify works on the accessibility of its checkout and admin, but your theme, apps and content are yours to fix. Most stores still have problems: the average Shopify home page has 75.1 detectable errors (WebAIM Million, 2026). Checking your own store is the only way to know where you stand.

What Shopify covers and what it leaves to you

Can I be sued for my website not being ADA compliant?

Yes. A shopper who cannot use your store can bring a claim under Title III of the ADA, and 3,948 website lawsuits were filed in 2025 (EcomBack). Being small or selling only online does not stop a claim from being filed. Fixing the problems and keeping a dated record of the work is the practical way to lower the risk.

Does my website need to be ADA compliant?

If you sell to people in the United States, it is safest to assume yes. The ADA has no written web standard, but courts and settlements point to WCAG 2.1 AA, and 3,948 website lawsuits were filed in 2025 (EcomBack). How courts treat online-only stores still differs by region.

Will Inclusely make my store ADA compliant?

No tool can promise that, and you should be wary of any that does. Automated checks cover about a third of the WCAG 2.1 AA success criteria. Inclusely finds and fixes those problems, guides you through the checks a person has to do, and keeps a record of the work.

How much does it cost to make my website ADA compliant?

It depends on how many problems your theme and content have, and who fixes them. Inclusely's planned plans run from free to $199 a month in US dollars for finding and fixing problems. If our developers change your theme code, that is a one-time charge priced by the work. No tool or price can promise compliance.

Is Inclusely an overlay?

No. Inclusely adds no widget or toolbar to your storefront by default. It changes your store's own product data, theme settings and theme code, and only after you approve each change. Shoppers keep using their own screen reader or browser settings.

Do accessibility widgets or overlays work?

Not as a fix. A widget adds a toolbar on top of the page but leaves the code underneath unchanged. In 2025, 24.9% of website accessibility lawsuits named sites that already had a widget (EcomBack), and the FTC ordered accessiBe to pay $1 million over its claims.

Do accessibility overlays work?

What is WCAG 2.2 AA?

WCAG 2.2 is the current version of the Web Content Accessibility Guidelines from the W3C, published October 5, 2023. Level AA is the level most laws and courts use. It covers things like image descriptions, colour contrast, keyboard use and clear form labels.

Does AODA apply to my online store?

It can. Ontario businesses with 50 or more employees must make their public website meet WCAG 2.0 AA. Those with 20 or more must file an accessibility compliance report by December 31, 2026. Some duties, like accepting feedback in accessible ways, apply to every business with an Ontario employee.

Does the European Accessibility Act apply to stores outside the EU?

It can, if you sell to consumers in the EU. The act has applied to online stores since June 28, 2025. Microenterprises with fewer than 10 staff and no more than EUR 2 million in turnover are exempt. Its standard, EN 301 549, follows WCAG 2.1 AA.

Does Inclusely check new products and pages?

Yes, that is part of the app at launch. New products, pages, theme publishes and apps will be checked as they appear, with scheduled scans on top. You get an alert when something new causes a problem, so you can fix it before shoppers run into it.

I got an ADA demand letter. What should I do?

Talk to a lawyer first and note the date you received it. Do not ignore it. Inclusely can then show what the letter points to, help you fix those problems quickly, and export a dated report of the work for your lawyer.

What to do after an ADA demand letter

Will it slow down my store?

No. Scans run on our servers, not in your shoppers' browsers. Nothing loads on your storefront unless you switch on one of the small optional fixes.

What about checkout?

Shopify builds and runs checkout, so no app can change its code. Inclusely checks the parts you control there, such as your brand colours, and reports checkout separately so you know what is yours to fix.

When does the app launch?

We have not set a public launch date. Inclusely is in early access now with a small group of Shopify stores. Early access stores get a free scan of their whole store, a call with our team, and hear first when the app opens on the Shopify App Store.
